Rückweisung wegen Gehörsverletzung als formeller Mangel Wird gestützt auf eine Eingabe einer Partei ein Entscheid gefällt, ohne der Ge- genpartei vorgängig die Möglichkeit einer Stellungnahme einzuräumen, wird damit der Anspruch der Gegenpartei auf rechtliches Gehör verletzt. Aufgrund der for- mellen Natur des Gehörsanspruches ist der Entscheid, unabhängig davon, ob dieser ohne die Verletzung anders ausgefallen wäre, aufzuheben. Ausnahmswei- se kann die Verletzung von der Rechtsmittelinstanz geheilt werden, wenn die Ver- letzung des rechtlichen Gehörs nicht gravierend ist und die Rechtsmittelinstanz die gleiche Kognition in Tat- und Rechtsfragen hat wie die Vorinstanz. Beschluss vom 18. Dezember 2013, RT130173 Obergericht, I. Zivilkammer Die Vorinstanz holte von der Beklagten eine Stellungnahme zum klägeri- schen Rechtsöffnungsbegehren ein. In der Folge wies sie das Rechtsöffnungsbe- gehren ab, ohne dem Rechtsöffnungskläger von der beklagtischen Stellungnah- me Kenntnis zu geben. Das Obergericht hebt den Entscheid auf und weist die Sache zur Wahrung des rechtlichen Gehörs an die Vorinstanz zurück. (Aus den Erwägungen:) "3. Die Vorinstanz hat es versäumt, dem Kläger die beklagtische Stellung- nahme vom 6. September 2013 vor der Urteilseröffnung zuzustellen. Selbst mit dem Endentscheid hat der Kläger keine Kenntnis der beklagtischen Ausführungen erhalten. Vor dem Hintergrund, dass in der Folge gestützt auf diese beklagtische Stellungnahme und die damit eingereichten Unterlagen ein Entscheid zu Unguns- ten des Klägers gefällt wurde, ohne dem Kläger vorgängig die Möglichkeit zur Stellungnahme einzuräumen, wurde sein Anspruch auf rechtliches Gehör verletzt. Wird eine Verweigerung des rechtlichen Gehörs durch die Vorinstanz festgestellt, so leidet der Entscheid an einem schweren Mangel und wird aufgrund der formel-

len Natur des Gehörsanspruchs, unabhängig davon, ob der Entscheid ohne die Verletzung anders ausgefallen wäre, aufgehoben (Sutter-Somm/Chevalier, in: Sutter-Somm/Hasenböhler/Leuenberger [Hrsg.], Kommentar zur Schweizerischen Zivilprozessordnung, 2.A., Basel 2013, N 26 zu Art. 53). Ausnahmsweise kann die Verletzung von der Rechtsmittelinstanz geheilt werden, wenn die Verletzung des rechtlichen Gehörs nicht gravierend ist und die Rechtsmittelinstanz die gleiche Kognition in Tat- und Rechtsfragen hat wie die Vorinstanz (Sutter-Somm/Che- valier, in: Sutter-Somm/Hasenböhler/Leuenberger [Hrsg.], a.a.O., N 27 zu Art. 53). Da die Verletzung vorliegend gravierend ist (der Kläger hat die beklagtische Stellungnahme bis heute nicht erhalten) und die Beschwerdeinstanz in Tatfragen nicht über die gleiche Kognition verfügt wie die Vorinstanz (vgl. Art. 320 ZPO; Freiburghaus/Afheldt in: Sutter-Somm/Hasenböhler/Leuenberger, a.a.O., N 5 zu Art. 320 ZPO, N 4 zu Art. 326 ZPO), ist eine Heilung der Gehörsverletzung aus- geschlossen. Das angefochtene Urteil ist daher aufzuheben und das Verfahren zur Wahrung des rechtlichen Gehörs des Klägers an die Vorinstanz zurückzuwei- sen."
