Superprovisorische Massnahmen können nie für sich allein stehen, sondern sind immer Teil eines Verfahrens betreffend vorsorgliche Massnahmen. Die nachge- holte Anhörung der Gegenpartei und der folgende Entscheid obliegen zwingend der anordnenden Instanz.

Die KESB A. (im Kanton Zürich) ging davon aus, sie sei grundsätzlich für Kindesschutzmassnahmen im zu beurteilenden Fall nicht zuständig, das sei vielmehr die KESB B. (im Kanton Tessin). Da sie eine konkrete Massnahme als besonders dringlich betrachtete, traf sie gleichwohl eine eigene Anord- nung. Diese erliess sie, ohne den Betroffenen anzuhören; gleichzeitig er- suchte sie die KESB B., die Anhörung nachzuholen. - Der Betroffene führt Beschwerde. Auf diese tritt das Obergericht nicht ein, fügt aber folgende Er- wägungen zum Verfahren an:

  1. Anstatt dem Beschwerdeführer mit ihrem Entscheid vom 12. August 2014 eine Frist zur Stellungnahme anzusetzen, unterrichtete die KESB A. die KESB B. über ihre Anordnung und bat diese, die notwendigen Schritte anhand zu nehmen (act. 12/1/2 S. 6 Ziff. 12). Auch wenn die KESB A. zum damaligen Zeit- punkt gestützt auf einen Entscheid des Bezirksrats vom 19. Mai 2014 (act. 13/37) davon ausgehen durfte, dass die KESB B. grundsätzlich zur Behandlung dieser Angelegenheit zuständig sei, war dieses Vorgehen falsch, da das Kindes- und Erwachsenenschutzrecht kein auf superprovisorische Massnahmen beschränktes Verfahren kennt und daher ein entsprechendes Verfahren zwingend mit der Ein- holung einer Stellungnahme fortzusetzen und mit einem neuen Entscheid über den Erlass einer ordentlichen vorsorglichen Massnahme abzuschliessen ist, ge- gen den die ordentlichen gesetzlichen Rechtsmittel gegeben sind (vgl. BGer 5A_579/2014 vom 18. August 2014 E. 2.2). Der Beschwerdeführer, der diesen Mangel rügt (act. 2 S. 4 f. Ziff. 1.1), könn- te deswegen grundsätzlich jederzeit eine Rechtsverweigerungsbeschwerde erhe- ben (Art. 450b Abs. 3 ZGB; BGer 5A_772/2013 vom 16. Mai 2014, E. 4.3.4). Un- ter den gegebenen Umständen erscheint es im Einklang mit der zitierten bundes- gerichtlichen Erwägung jedoch angezeigt, dies von Amtes wegen festzustellen und der KESB A. die Anweisung zu erteilen, dem Beschwerdeführer das rechtli- che Gehör einzuräumen und die Angelegenheit beförderlich zu behandeln (wie

bereits im Entscheid der Kammer vom 2. September 2014 zur Zuständigkeit ge- schehen; act. 13/48 S. 9 E. 2.5 und S. 11 Dispositiv-Ziffer 1 Satz 2).
