BRKE I Nr. 396/1994 vom 9. Dezember 1994in BEZ 1995 Nr. 7 Auch unter der Herrschaft des Wasserwirtschaftsgesetzes vom 2. Juni 1991 (WWG; in Kraft seit dem 1. Januar 1993) sind die Gemeinden zur Beurteilung der Frage zuständig, ob der vormals in § 263 PBG geregelte kantonalrechtliche Gewäs- serabstand von 5 m (§ 21 Abs. 1 WWG) bzw. die kommunalen Gewässerabstandsli- nien (§ 67 PBG) eingehalten sind. Die Dispensierung von kommunalen Gewässer- abstandslinien fällt ebenfalls in die Zuständigkeit der Gemeinden (§ 2 lit. c PBG), während Ausnahmebewilligungen vom kantonalrechtlichen Mindestgewässerab- stand in der Kompetenz der Baudirektion stehen (§ 21 Abs. 2 WWG). 4.c) Bestehen kommunale Gewässerabstandslinien und werden wie im vor- liegenden Fall durch das Bauvorhaben sowohl der kommunale als auch der kanto- nale Gewässerabstand verletzt, so hat zunächst die Gemeinde zu entscheiden, ob die Unterschreitung des kommunalen Gewässerabstandes zulässig sei oder nicht. Ist die Bewilligung zu verweigern, so muss das Bauvorhaben nicht auch noch der kantonalen Behörde vorgelegt werden. Dies wäre erst dann erforderlich, wenn die Gemeinde die für die Unterschreitung des kommunalen Abstandes erforderliche Be- willigung erteilen würde oder wenn gar kein durch eine Gewässerabstandslinie im Sinne von § 67 PBG festgelegter kommunaler Gewässerabstand bestünde. 5.a) Kommunale Gewässerabstandslinien gemäss § 67 PBG sind nicht mit den Baulinien für Fluss- und Bachkorrektionen bzw. für Uferwege und dgl. im Sinne von § 96 PBG zu verwechseln. Solche Baulinien dienen ausschliesslich der Sicherung bestehender und geplanter Anlagen. Die Gewässerabstandslinien sind dagegen als In strument für die Erhöhung des kantonalrechtlichen Mindestgewässerabstandes vorgesehen und erfüllen eine raumplanerische Funktion beispielsweise zur Siche- rung von Erholungs räumen oder von geschützten Landschaften oder Vegetationen entlang von Fluss- und Bachufern. Sie bestimmen den Abstand zwischen Bauten und Anlagen einerseits und den öffentlichen Gewässern andererseits, wie dies bei Gebäude- und Grenzabständen in bezug aufdie Distanz zwischen den Bauten und den Grundstücksgrenzen bzw. zwischen den Bauten unter sich der Fall ist. Die Rechts wirkungen der Gewässerabstandslinien imSinne von § 67 PBG richten sich daher nicht nach den §§ 99 ff. PBG. Werden kommunale Gewässerabstandslinien verletzt, so kann eine Bewilligung demnach nur erteilt werden, wenn die Vorausset- zungen von § 220 PBG oder von § 357 PBG erfüllt sind.
