BRKE I Nr. 264/1995 vom 25. August 1995in BEZ 1995 Nr. 36 6. b) Gemäss heute gültiger Bau- und Zonenordnung der Gemeinde X. bestehen für Bauten in der Zone W1.3 m3/m2 keine Geschosszahlbeschränkungen mehr. Die Bau- und Zonenordnung schreibt lediglich vor, dass Bauten in der betreffenden Zo- ne eine Gebäudehöhe von maximal 6,5 m und eine Firsthöhe von maximal 4 m auf- weisen dürfen. Zudem ist gemäss Ziff. 221 bis BZO die Aufteilung der Nutzung auf Dach-, Unter- und Vollgeschosse innerhalb der Gebäude- und Firsthöhe frei. Damit erübrigt es sich auch, die vorliegend geplante Aufstockung einer bestimmten Ge- schosskategorie zuzuteilen. Als Folge der liberalisierten kommunalen Vorschriften, welche grundsätzlich innerhalb der Höhenprofile eine freie Geschosskonfiguration und Nutzungsverteilung zulassen, kann nämlich im Falle von Flachdachbauten nicht mehr verlangt werden, dass Gebäudeteile, welche über die für die Gebäudehöhe gültige Profillinie hinaus in den - theoretischen - Profilbereich eines maximal zuläs- sigen Satteldaches ragen, deutlich als Dachgeschosse erkennbar sein müssen. Dies hat zur Folge, dass Flachdachbauten innerhalb des für Bauten mit Satteldach zuläs- sigen Profils grundsätzlich frei gestaltet werden können. c) Das streitbetroffene Gebäude ist eine Flachdachbaute an Hanglage. Die pro- jek tierte Aufstockung beschlägt die bergseitige Hälfte des darunter liegenden Ge- schosses. An der rückwärtig gelegenen Nordfassade wird - wie auch an den beiden Seitenfassaden - die zulässige Gebäudehöhe von 6,5 m eingehalten. Der südliche Teil der Aufstockung ragt jedoch über die für die Gebäudehöhe gültige Profillinie hinaus. Da die - theoretische - Profillinie für ein Satteldach indessen ohne weiteres gewahrt wird, ist das Projekt aus den vorgenannten Gründen nicht zu beanstanden. Davon abgesehen weist die - der Hanglage angepasste - in den Plänen eingezeich- nete Dachprofillinie durchwegs Neigungswinkel von weniger als 45° auf, so dass das Projekt selbst dann nicht zu beanstanden wäre, wenn derjenige Teil der Aufsto- ckung, welcher die Gebäudehöhe überschreitet, - gleichsam als Attikageschoss - un- terhalb eines Dachprofiles mit 45°-Winkel liegen müsste (VB 93/0077).
