Hefti, Berichterstatter: Es bestehen zwei Differenzen. Ihre Kommission beantragt Ihnen mehrheitlich, in beiden Punk- ten an der bisherigen Fassung des Ständerates festzuhalten. Beim ersten Punkt geht es um den Kreis derjenigen, welche zur Beschwerde an das Bundesgericht berechtigt sind. Ihre Kommission ist der Auffassung, dass im Hinblick auf die Belastung des Bundesgerichts nicht jene Erweiterung des Kreises der Beschwerdeberechtigten erfolgen soll, wie sie die Fassung des Nationalrates zur Folge hätte. Beim zweiten Punkt geht es darum, wie weit das Bundesgericht auch den Sachverhalt überprüfen kann. Hier müssen wir uns bewusst sein, dass die Sachverhaltsfeststellung der Beschwerdein- stanz etwas rudimentär sein kann, denn an sich ist das Verwaltungsverfahrensgesetz mit seinen Möglichkeiten nicht anwendbar. Aus dieser Überlegung beantragt die Kommission auch hier Festhalten.
