The Federal Assembly, acting under Article 6 of the Federal Constitution and following the Federal Council's message, granted federal guarantee to selected revised provisions of the cantonal constitutions of Fribourg, Thurgovia, Neuchâtel, and Geneva. The decree also notes that it is not of general application and is not subject to referendum.
Art. 6 Federal Constitution; federal guarantee of revised cantonal constitutions. The Federal Assembly may grant federal guarantee to cantonal constitutional amendments submitted after popular approval when the constitutional prerequisites are met and no objection is raised in the federal review. The guarantee may relate to individual provisions and, where applicable, to the abrogation of prior constitutional clauses. A federal decree of this kind is not of general application and is not subject to referendum.
Arrêté fédéral accordant la garantie fédérale aux constitutions révisées de certains cantons
du 17 décembre 1992
L'Assemblée fédérale de la Confédération suisse, vu l'article 6 de la constitution; vu le message du Conseil fédéral du 31 août 19921), arrête:
Article premier
La garantie fédérale est accordée:
A l'article 75 bis ainsi qu'à l'abrogation de l'article 77, 2e alinéa, de la constitution cantonale, acceptés en votation populaire du 16 février 1992;
Au paragraphe 53, 1er alinéa, de la constitution cantonale, accepté en votation populaire du 16 février 1992;
A l'article 39, 2e et 3e alinéas, de la constitution cantonale, accepté en votation populaire du 30 septembre 1991;
Aux articles 133 et 136, 1er et 2e alinéas, ainsi qu'à l'abrogation de l'article 136, 3e alinéa, de la constitution cantonale, acceptés en votation populaire du 29 sep- tembre 1991, de même qu'à l'article 10A de la constitution cantonale, accepté en votation populaire du 16 février 1992.
Art. 2
Le présent arrêté, qui n'est pas de portée générale, n'est pas sujet au référendum.
