Sintesi

In a recusal matter in case AC 94/029, the Vaud Administrative Court noted that Judge Eric Brandt had already self-recused and that counsel for Janine and Pierre Schmit waived the recusal of assessors Paul Blondel and Pierre Richard. The plenary court therefore removed the matter from the docket. It also ordered that the decision be rendered without court costs and granted the applicants CHF 500 in party compensation payable by the court treasury.

La Cour plénière,

  • vu la récusation spontanée du juge Eric Brandt en date du 27 octobre 1994,

  • vu le courrier du conseil des requérants qui, interpellé, déclare qu'il renonce à la récusation des assesseurs Paul Blondel et Pierre Richard,

  • considérant que les requérants obtiennent partiellement gain de cause en étant assistés d'un avocat,

I. raye la cause du rôle;

II. dit que la présente décision est rendue sans frais;

III. alloue aux requérants la somme de 500 francs (cinq cents francs) à titre de dépens à la charge de la caisse du Tribunal administratif.
