RI 1 appealed against the State Council’s approval of the zoning plan of the municipality concerned. Before the Tribunal della pianificazione del territorio decided the merits, the appellants notified the court on 26 November 2004 that they were withdrawing the appeal. The court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no fees or expenses be collected. The decree was issued in Lugano on 10 January 2005 by President Raffaello Balerna, assisted by Secretary Leopoldo Crivelli.
Withdrawal of appeal; striking off the docket and costs: where the appellant withdraws the appeal before judgment, the proceedings become moot and the court orders the case struck from the roll. In the absence of contrary circumstances, no court fees or costs are levied (consid. 1-2).

decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
