The appellant filed a planning appeal against the State Council’s approval of a zoning plan. By letter of 14/17 October 2003, the appellant’s guardian withdrew the appeal. The Tribunal held that the proceeding was therefore concluded and ordered the appeal stricken from the docket. It further decided that no court fees or costs would be charged.
Withdrawal of an administrative appeal; procedural consequence of striking the case from the docket and waiver of fees and costs where the proceeding is thereby exhausted. Once the appellant validly withdraws the appeal, the court no longer has to decide the merits and may remove the case from its roll (consid. 1). In such circumstances, and absent a contrary basis, no taxes or procedural expenses are levied (consid. 2).
