The appellants filed an appeal against the Cantonal Government’s approval of a municipal zoning plan. Before the tribunal ruled on the merits, they informed the court in writing that they were withdrawing the appeal. The Tribunal of Territorial Planning therefore removed the case from its docket and ordered that no fees or costs be collected. No substantive ruling on the zoning plan was issued.
Appeal withdrawal; striking out from the docket and costs: when appellants withdraw a pending appeal, the court removes the case from the docket without deciding the merits. In the absence of a substantive determination, the court may order that no fees or costs be charged (consid. 1-2).
