The appellant challenged a forest-area determination decision of the Sezione forestale before the Tribunal of the planning territory in Lugano. Before the court ruled on the merits, the appellant's representative notified the tribunal that the appeal was withdrawn. The tribunal therefore struck the appeal from the roll and ordered that no fees or costs be collected.
Appeal withdrawn; strike-out from the roll and no costs. When the appellant expressly withdraws the appeal, the proceeding is terminated by removal from the docket; absent a contrary reason, no court fees and no costs are levied (consid. 1-2).
