The commune appealed against a cantonal resolution approving the revision of its municipal zoning plan and detailed plans. At the hearing on 18 September 2001, the commune withdrew the appeal. The Tribunal of Territorial Planning therefore found the case moot, struck the appeal from the docket, and ordered that no fees or costs be levied.
Mootness and withdrawal of appeal; where the appellant withdraws the appeal at the hearing, the appellate court strikes the case from the docket because no live dispute remains. In such circumstances, the proceedings are terminated without adjudicating the merits; costs may be waived where the court so orders.
