The appellants challenged a 2001 State Council decision concerning the forest boundary in a municipality. Before the TPT decided the merits, counsel for the appellants notified the court by letter of 12 October 2001 that the appeal was withdrawn. The court held that the matter had become moot and ordered the appeal struck from the docket. It further decided that no court fees or costs would be levied.
Withdrawal of appeal; mootness; costs. Where the appellant withdraws the appeal before the merits are decided, the proceeding becomes devoid of object and is struck from the docket. In such circumstances, and absent contrary indications, no fees or costs are charged (consid. 1-2).
