The Planning Tribunal of Ticino dealt with an appeal against a State Council decision concerning the refusal to open a minor zoning-variance procedure. Before the court decided the merits, the appellant’s lawyer informed the tribunal by letter of 4 August 2000 that the appeal was being withdrawn. The tribunal therefore found the case moot, struck the appeal from the roll, and ordered that no fees or costs be levied.
Withdrawal of an appeal renders the proceedings devoid of object; the appellate court must strike the case from the roll. In such circumstances, absent a live controversy, no merits examination is carried out. Where the case is discontinued on this ground, the court may dispense with court fees and expenses (consid. 1-2).
