The appellant challenged a decision of the Department of the Territory concerning the general plan for an area in Lugano. At the hearing on 19 October 1999, the appellant declared that the appeal was withdrawn. The Tribunal of the territorial planning therefore found the case moot and ordered the appeal struck out from the docket. It also decided that no court fees or costs would be collected.
Withdrawal of the appeal at the hearing renders the case moot; in the absence of a live dispute, the appellate court strikes the proceeding from the docket. Where the matter becomes without object due to withdrawal, no fees or costs are ordinarily levied (cf. consid. 1-2).
