The appellants challenged a decision delimiting forest land at the edge of a building zone. After the appellants’ lawyer withdrew the appeal by letter, the Tribunal of Territorial Planning held that the case had become moot and ordered the appeal struck from the docket. It further decided that no court fees or costs would be charged.
Withdrawal of an administrative appeal; mootness and costs: if the appellant withdraws the appeal before the decision is rendered, the court removes the matter from the docket for lack of object. In such circumstances, and absent special reasons, no court fees or expenses are levied (consid. implicit).
