The appellants challenged a State Council resolution approving the revision of the zoning plan and detailed plans for the nuclei of a municipality. Before the planning court decided the case, their representative withdrew the appeal by letter of 13 November 1998. The court therefore held that the matter had become moot, struck the appeal from the docket, and ordered that no fees or costs be taken.

Withdrawal of an appeal renders the proceeding moot; the court may strike the case from the docket. In the absence of a live dispute, the merits are not examined. If the proceeding is terminated in this manner, no fees or costs need be charged where the court so orders (consid. 1-2).
