The appellant withdrew its appeal on 2004-02-02 in proceedings before the Ticino Territorial Planning Court against the State Council's approval of a detailed industrial zoning plan. The court noted that the proceedings were therefore exhausted and ordered the appeal struck from the docket. It further decided that no court fees or expenses would be charged.
Withdrawal of the appeal renders the proceedings moot and leads to striking the case from the roll; absent a pending dispute, the court does not decide the merits. Where the withdrawal terminates the proceedings, the court may order that no fees or costs be collected (consid. 1-2).
