The appellant appealed against a 7 May 1997 State Council resolution approving an amendment to a municipal zoning plan. Before the court ruled on the merits, the appellant informed the court on 6 October 1997 that it was withdrawing the appeal. The Tribunal therefore held that the case had become moot, struck the appeal from the docket, and decided that no fees or costs would be charged.
Withdrawal of the appeal renders the matter moot; in the absence of a live dispute, the court strikes the case from the docket. Where the proceeding ends in this manner, and absent contrary circumstances, no court fees or expenses are levied (consid. implicit).
