The appellants challenged a State Council resolution approving a municipal zoning plan. At the hearing before the Territorial Planning Court on 5 February 1998, they withdrew the appeal. The court held that the case had become moot and struck the appeal from the docket. It also ordered that no court fees or costs be charged.
Withdrawal of an appeal before the cantonal planning court renders the proceedings moot; the appeal is struck from the docket. In such a situation, and absent special circumstances, no court fees or expenses are levied (consid. implicit).
