Six appellants challenged a State Council resolution concerning the revision of the landscape plan and certain zoning variants of the municipal land-use plan. Before the court ruled on the merits, their counsel filed a letter withdrawing the appeal. The Tribunal of Territorial Planning held that the case had become moot and struck the appeal from the docket. It also ordered that no court fees or costs be charged.
Withdrawal of an administrative appeal renders the proceedings moot; the court strikes the case from the docket. In the absence of a live dispute, no fees or costs are levied where the court so orders in the dispositive part.
