The Tribunal of the Ticino land-planning authority dealt with an appeal against a municipal resolution. Before the merits were decided, the appellant informed the court by letter that the appeal was withdrawn. The court therefore found the matter moot, struck the case from the rolls, and ordered that no court fees or costs be levied.
Withdrawal of the appeal; mootness of the proceedings. Where the appellant expressly withdraws the appeal before judgment, the dispute loses its subject matter and the court strikes the case from the docket; in such circumstances, no fees or costs are levied when the court so orders (consid. implicit).
