The Territorial Planning Court of Ticino dealt with an appeal against a State Council resolution approving a zoning plan amendment. Before the court ruled, the appellants' representative withdrew the appeal by letter of 1 June 1999. The court therefore held that the dispute had become moot and ordered the appeal struck from the docket. It also decided that no court fees or expenses would be collected.

Regest

When an appeal is withdrawn before judgment, the court declares the proceeding moot and strikes the case from the docket; in such circumstances, it may order that no court fees or costs be charged. The dismissal is procedural and does not address the merits of the contested administrative act (consid. 1-2).
