During a site inspection and hearing concerning an artificial pond, the Tribunal di appello della pianificazione del territorio asked the municipality to provide, by 30 December 1996, a survey of naturalistic interventions on the communal territory that it considered substitutes for the SSIC pond. The tribunal stated that it would transmit the document to the UPM for its position. For the remaining questions, the parties maintained their positions. The document is a procedural hearing record rather than a merits judgment.

Procedural order in planning matters; where the appellate planning tribunal requires further documentation on a contested environmental or planning substitute measure, it may direct the municipality to file a survey before continuing the examination and may submit the file to the competent administrative service for comment. Such interim case-management measures do not decide the merits of the zoning or environmental dispute (cf. consid. unspecified).

In sede di discussione sul problema dello stagno artificiale, il TPT chiede al Municipio di trasmettere il rilevamento degli interventi naturalistici effettuati sul territorio comunale e ritenuti dal Comune sostitutivi dello stagno SSIC entro il 30 dicembre 1996.

Il Tribunale trasmetterà questo documento all’UPM perché prenda posizione.
