Sintesi

The appellants challenged a State Council resolution concerning the inventory of buildings outside the building zone in the municipality. After the appeal was filed, the State Council adopted a later resolution approving a variant that granted the relief sought. The Tribunal held that the dispute had therefore become moot and ordered the appeal struck from the docket. No fees or costs were imposed.

Mootness; subsequent administrative decision granting the relief sought renders the appeal devoid of object and it is struck from the docket. When the contested decision is superseded by a later, uncontested act that accedes to the appellant’s requests, the reviewing court no longer rules on the merits and may waive fees and costs.

visto che con risoluzione n. __________ del 5 agosto 1997, cresciuta incontestata in forza di cosa decisa, il Consiglio di Stato ha approvato una variante che accede alle domande ricorsuali;

rilevato che la causa é in tal modo divenuta priva d’oggetto;

decreta

  1. Il ricorso é stralciato dai ruoli.

  2. Non si prelevano tasse e spese.
