The appellants challenged a decision of the Ticino State Council approving amendments to a municipal zoning plan. At the hearing before the Territorial Planning Court, their representative withdrew the appeal. The court held that the case had therefore become moot and ordered the appeal struck from the register. It also ordered that no fees or costs be charged.
Withdrawal of the appeal renders the proceedings moot; in such a situation the court strikes the case from the roll and may dispense with court fees and costs. The decisive factor is the absence of a live dispute once the appellants expressly abandon the challenge (consid. 1).
