The appellants challenged a State Council resolution approving a municipal zoning plan. Before the tribunal ruled on the merits, they withdrew the appeal by letter of 14 August 1996. The Tribunal of Territorial Planning therefore found that the case had become moot and struck the appeal from the docket. It also ordered that no court fees or costs be collected.
Withdrawal of the appeal renders the proceedings moot; the court removes the case from the docket and may refrain from charging fees and costs. In such a situation, no merits examination is carried out (consid. implicit).
