The Ticino Territorial Planning Court dealt with an appeal against the State Council's approval of a zoning plan. On 23 February 2004 the appellant, through counsel, withdrew the appeal. The court therefore considered the proceedings terminated, struck the matter from the docket, and ordered that no fees or costs be charged.
Withdrawal of appeal; proceedings become moot and are struck from the docket. Where the appellant formally withdraws the remedy, the court no longer has a substantive dispute to decide and orders the case removed from the roll. In the absence of a continuing controversy, no court fees or expenses are levied (consid. 1-2).
