In an IC/IFD 2001 tax appeal, the appellant withdrew the recourse by declaration of 2005-02-08. The Tribunal of Appeal's Tax Chamber therefore struck the case from the docket and ordered that no court costs or justice fee be charged. The decision was served on the parties and indicated that administrative-law appeal to the Federal Tribunal was available within 30 days.
Withdrawal of appeal; striking-off of the case from the docket. Where the appellant validly withdraws the recourse, the appellate tax court removes the proceedings from the roll. In the absence of a specific cost order and where the applicable provisions on costs so allow, no court costs or justice fee are levied; the decision is rendered as a procedural order and remains subject to the ordinary federal administrative-law appeal route (consid. 1-2).
