In a second-instance tax-at-source proceeding, the appellant withdrew the appeal by letter dated 14 February 2003. The president of the Tax Chamber of the Court of Appeal noted that the withdrawal made the case devoid of object and ordered the appeal struck from the docket. The court also ordered that no court fees or justice fees be levied.
Tax appeal withdrawn; once the appellant withdraws the remedy, the case becomes devoid of object and is struck from the docket. In such circumstances, the court may terminate the proceedings without charging court fees or justice fees, pursuant to the applicable cantonal and federal provisions cited by the court (consid. 1-2).
