The tax chamber of the cantonal court of appeal noted that the appellant withdrew the appeal by letter of 2 September 2003. As a result, the appeal had become without object and was struck out of the docket. The court also ordered that no costs or justice fee be collected.
Art. 207 cpv. 2 e 228 LT; art. 134 cpv. 2 e 142 cpv. 4 LIFD: when an appeal is withdrawn, the court may strike the proceedings from the docket because the remedy has lost its object. In such a procedural termination, the court may dispense with court costs and justice fees where the applicable rules so allow. The decision is limited to the procedural consequence of withdrawal and contains no ruling on the merits.
