In a tax appeal concerning IC/IFD 99/00, the appellants’ representative informed the court by letter of 10 December 2002 that the appeal was withdrawn. The Camera di diritto tributario of the Ticino Court of Appeal held that the case had therefore become moot and ordered the appeal struck from the roll. It further decided that no costs and no justice fee would be levied.
Art. 207 cpv. 2 LT; art. 228 LT; art. 134 cpv. 2 LIFD; art. 142 cpv. 4 LIFD: if the appellant withdraws the tax appeal, the proceeding becomes moot and is struck from the roll. In such a situation the court may dispense with both costs and a justice fee.
