The Tax Chamber of the Cantonal Court of Appeal dealt with an appeal concerning a tax reminder fee. Before the court decided the merits, the appellant's representative withdrew the appeal by letter dated 27 October 2001. The court held that the appeal had therefore become moot, struck it from the docket, and ordered that no court costs or justice fee be collected.
Art. 207 cpv. 2 and 228 LT; Art. 134 cpv. 2 and 142 cpv. 4 LIFD; withdrawal of the appeal renders the proceedings devoid of object. If the appellant expressly withdraws the appeal, the court strikes the case from the rolls; in such circumstances, no costs or justice fee are levied where the applicable provisions so provide.
