The Ticino Tax Chamber of the Court of Appeal dealt with a tax appeal concerning a request for security for cantonal and federal income taxes. Before judgment, the appellant’s representative informed the court that the appeal was withdrawn. The court therefore held that the matter had become moot and ordered the appeal struck from the roll. It further decided that no court costs or judicial fee would be levied.
Withdrawal of the appeal renders the proceeding devoid of object; the appellate court will strike the case from the docket ex officio or upon notice of withdrawal. Where the matter has become moot, no substantive determination is made and costs may be waived according to the applicable cantonal and federal provisions (consid. implicit in the decree).
