The appellant in a cantonal tax case withdrew the appeal by letter dated 5 February 1996. The Camera di diritto tributario of the Tribunal d'appello held that the appeal had therefore become without object and ordered it struck from the docket. It further decided that no court costs or justice fee would be charged.
Art. 181 cpv. 2 LT; withdrawal of the appeal renders the proceedings devoid of object and justifies striking the case from the docket. Where the appeal is withdrawn, the appellate tax court may terminate the proceedings without entering into the merits and, depending on the circumstances, waive the collection of costs and justice fees (consid. implicit).
