The President of the Assise Correzionali asked the Ticino cantonal criminal court to convert an unpaid fine of CHF 1,000 imposed on CD1 by judgment of 25 September 2002. The court held that the fine remained unpaid, debt collection was no longer an effective enforcement method, and the convicted person had provided no justification for non-payment. Vista l’istanza 23 gennaio 2004 del Presidente delle Assise Correzionali di, con la quale chiede la commutazione in arresto della multa di sfr. 1'000.-- (di cui fr. 500.-- già versati) inflitta con sentenza 25.9.2002 a
CD1 domiciliato a
Considerato che il condannato non ha pagato la multa e che l’esecuzione per debiti non appare più provvedimento efficace;
ritenuto che lo stesso non ha fatto pervenire giustificazione alcuna del mancato pagamento.
Richiamati gli art. 49 CPS e 347 cfr. 1 lett. a CPP
decreta 1. La multa di sfr. 1'000.-- (di cui fr. 500.-- già versati) inflitta dal Presidente delle Assise correzionali di a CD1 con sentenza 25.9.2002 è commutata in 16 (sedici) giorni di arresto.
Non si prelevano né tasse né spese.
