RI 1, represented by PA 1, appealed against a 24 November 2004 decision of the examining and arrest judge concerning provisional liberty. After the appellant was released, counsel withdrew the appeal on 3 December 2004. The Criminal Chamber of the Court of Appeal held that there was no longer any current or even ideal interest in deciding the matter and therefore struck the appeal from the docket. It also waived court fees and costs.
Art. 95 ss. and 284 ss. CPP; withdrawal of an appeal after the appellant's release renders the proceedings moot if no current or ideal interest in a decision remains. In such circumstances the appellate court may strike the case from the docket and, where appropriate, waive court fees and expenses (consid. implicit).

la decisione 24.11.04 emanata dal giudice dell’istruzione e dell’arresto Ursula Züblin in materia di libertà provvisoria;
preso atto che la patrocinatrice del ricorrente ha ritirato il ricorso con scritto 3.12.2004 a seguito dell’avvenuta scarcerazione di quest’ultimo;
considerato che non esiste un interesse né attuale né ideale a comunque decidere sul ricorso;
ritenuto che si può quindi rinunciare al carico di tassa di giustizia e di spese.
Per questi motivi,
visti gli art. 95 ss. e 284 ss. CPP e ogni altra norma applicabile,
decreta
Il ricorso è stralciato dai ruoli.
Non si prelevano tassa di giustizia e spese.

The appeal was struck out of the docket because counsel withdrew it after the appellant's release and no current or ideal interest remained.
