The Criminal Appeals Chamber of the Ticino Court of Appeal dealt with an application challenging a June 24, 2004 non-prosecution order in a defamation and calumny matter. Before the court ruled on the merits, the applicant withdrew the appeal in writing on August 13/16, 2004. The court therefore ordered the case struck from the roll and decided that no justice fee or costs would be charged.
Art. 186 CPP; withdrawal of the appeal or application renders the proceeding devoid of object and justifies striking the case from the roll. Where the party expressly withdraws the gravame, the appellate court does not examine the merits and may order removal from the docket; absent special circumstances, no justice fee or costs are levied.
