IS 1 challenged a non-lieu decision in a criminal matter. The Chamber of criminal appeals had previously ordered the appeal to be amended within 10 days, warning that it would be struck out otherwise. The deadline elapsed without any correction. The court therefore removed the case from its rolls and ordered IS 1 to pay reduced costs and fees of CHF 70.
Art. 186 CPP; failure to comply with an order to cure defects in an appeal within the prescribed time limit justifies striking the proceeding from the docket. Where the appellant lets the deadline expire unused, the court may terminate the matter without examining the merits and charge the reduced procedural costs to the party responsible, pursuant to the applicable costs provisions (Art. 39 lett. f LTG).

in relazione
al decreto di non luogo a procedere 16.6.2004 emanato dal sostituto procuratore pubblico Clarissa Torricelli Bernasconi nei confronti di PI 1, __________, per titolo di appropriazione indebita, furto, estorsione, minaccia e coazione;
richiamata l'ordinanza 5.7.2004 di questa Camera, che invitava l'istante ad emendare il gravame entro il termine di 10 giorni, sotto comminatoria di stralcio dal ruolo del procedimento;
rilevato che nel frattempo il termine assegnato è decorso infruttuoso;
ritenuto pertanto che il procedimento può essere stralciato dal ruolo, caricando la tassa, ridotta, e le spese di giudizio alla parte che le ha occasionate;
visti gli art. 186 CPP, sulle spese l'art. 39 lett. f LTG e ogni altra norma applicabile;
decreta
L'istanza è stralciata dai ruoli.
La tassa e le spese per complessivi fr. 70.-- (settanta), sono a carico di IS 1
