The Criminal Appeals Chamber of the Ticino Court of Appeal struck out an application to promote prosecution against a non-prosecution decree concerning insult and threat. The applicant had been ordered to cure formal defects within 10 days, under warning of striking out, but let the deadline lapse unused. The court therefore removed the case from the docket and charged the reduced fee and costs of CHF 70 to the applicant.
Art. 186 CPP; Art. 39 lett. f LTG; failure to cure formal defects within the court-ordered time limit after express warning of striking out justifies removal of the proceeding from the docket. The procedural consequence follows once the deadline expires unused; costs are borne by the party who occasioned the proceeding.

in relazione
al decreto di non luogo a procedere 24.5/11.6.2004 emanato dal procuratore pubblico Luca Maghetti nei confronti di __________ PI 1, __________, e PI 2, __________, per titolo di ingiuria e minaccia;
richiamata l'ordinanza 22.6.2004 di questa Camera, che invitava l'istante ad emendare il gravame entro il termine di 10 giorni, sotto comminatoria di stralcio dal ruolo del procedimento;
rilevato che nel frattempo il termine assegnato è decorso infruttuoso;
ritenuto pertanto che il procedimento può essere stralciato dal ruolo, caricando la tassa, ridotta, e le spese di giudizio alla parte che le ha occasionate;
visti gli art. 186 CPP, sulle spese l'art. 39 lett. f LTG e ogni altra norma applicabile;
decreta
L'istanza è stralciata dai ruoli.
La tassa di giustizia e le spese per complessivi fr. 70.-- (settanta), sono a carico di IS 1, __________ .
