The Ticino Criminal Appeals Chamber dealt with an application for promotion of prosecution challenging a non-prosecution order. After the filing had been transferred to the investigating judge because legal aid counsel was requested, counsel was appointed and the Chamber ordered amendment of the filing within 10 days, warning of strike-out. The deadline expired without compliance. The Chamber therefore removed the proceeding from the docket and charged the applicant with reduced court fees and costs of CHF 50.
Art. 186 CPP; when a party does not comply with a court-ordered amendment of a filing within the prescribed time limit, after warning of strike-out, the appellate criminal chamber may remove the proceeding from the roll. Costs may be charged, in reduced amount, to the party whose procedural omission caused them; see consid. 1-2.

in relazione
al decreto di non luogo a procedere 13.5.2004 emanato dal sostituto procuratore pubblico Clarissa Torricelli Bernasconi;
preso atto che l'istanza 8/9.6.2004 di __________ IS 1 è stata trasmessa il 16.6.2004 per competenza al giudice dell’istruzione e dell’arresto, in quanto veniva richiesta la nomina un difensore d'ufficio;
preso atto che con decisione 3.9.2004 veniva nominato un difensore d'ufficio;
richiamata l'ordinanza 7.9.2004 di questa Camera, che invitava lo stesso ad emendare il gravame 8/9.6.2004 entro il termine di 10 giorni, sotto comminatoria di stralcio dal ruolo del procedimento;
rilevato che nel frattempo il termine assegnato è decorso infruttuoso;
ritenuto pertanto che il procedimento può essere stralciato dal ruolo, caricando la tassa, ridotta, e le spese di giudizio alla parte che le ha occasionate;
visti gli art. 186 CPP, sulle spese l'art. 39 lett. f LTG e ogni altra norma applicabile;
decreta
L'istanza é stralciata dai ruoli.
La tassa di giudizio e le spese per complessivi fr. 50.-- (cinquanta), sono a carico di __________ IS 1, __________.
