con la quale chiede l’autorizzazione a consultare gli incarti penali nei quali è parte __________ PI 2, __________;

preso atto delle osservazioni 15/16.6.2004 del sostituto procuratore pubblico Monica Casalinuovo, che non si oppone alla visione degli atti;

letti ed esaminati gli atti;

in fatto ed in diritto

  1. Con istanza 2/11.6.2004 la __________ del __________ ha chiesto di poter consultare una serie d’incarti nei quali è parte __________ PI 2, in relazione ad una richiesta di quest’ultimo per l’acquisto di due armi da fuoco.

  2. Giusta l’art. 27 CPP - in vigore dall’1.1.1996, che ha precisato e completato il previgente art. 8 vCPP, con riferimento anche alla giurisprudenza del Tribunale federale (DTF 110 Ia 83 e 95 I 108) - "oltre ai casi previsti dal presente codice, la Camera dei ricorsi penali può permettere l’ispezione degli atti di un processo e l’estrazione di copie a chi giustifica un interesse giuridico legittimo che prevale sui diritti personali delle persone implicate nel processo, segnatamente su quelli delle parti, del denunciante, dei testimoni e dei periti. La Camera dei ricorsi penali fissa le modalità dell’ispezione".

Nella fattispecie i presupposti di legge appaiono dati, stanti le ragioni che giustificano l’istanza, la facoltà dell’autorità chiamata a decidere nella specifica questione (cfr. art. 10 LCLArm), la sua facoltà d’indagine d’ufficio, non da ultimo il suo vincolo al segreto d’ufficio e, in particolare, l’art. 13 LCLArm che prevede segnatamente che pure le autorità giudiziarie, anche se vincolate dal segreto d’ufficio, comunicano gratuitamente quelle informazioni che risultano utili e necessarie per l’applicazione della LArm e della normativa d’applicazione cantonale.

  4. L’istanza va pertanto accolta e gli atti potranno essere consultati presso il Ministero pubblico.

Vista la qualità dell'istante, non si prelevano tassa di giustizia e spese.

Per questi motivi,

richiamato l'art. 27 CPP e ogni altra norma applicabile,
