AT1 filed a petition seeking CHF 500 in recourse against CV1 for damage linked to the closure of the municipal water network. On 27 September 2004 the applicant withdrew the appeal. The Administrative Court therefore struck the case from the docket. It ordered no court fees or expenses, but granted CV1 CHF 250 in party compensation because CV1 was represented by licensed counsel.
Withdrawal of the appeal; the proceedings become devoid of object and are struck from the docket. In such a case the court may dispense with court fees, but it may still award party compensation to the respondent when representation by licensed counsel justifies an indemnity for necessary legal expenses.

chiedente
in via di rigresso a CV1 il versamento di fr. 500.- quale partecipazione al danno subito dal comune a seguito della chiusura della rete idrica comunale;
preso atto che il 27 settembre 2004 la parte attrice ha comunicato di ritirare il ricorso;
ritenuto che CV1 si è avvalso dell'assistenza di un legale iscritto all'albo, per cui si giustifica la corresponsione di un'indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Il comune di AT1 rifonderà fr. 250.- a CV1 a titolo di ripetibili.
