The anonymous plaintiff filed a petition against the State and Republic of the Canton of Ticino. On 20 April 1999, the plaintiff's counsel withdrew the petition. The Administrative Court accordingly held that the proceedings were exhausted, ordered the case stricken from the roll, and decided that no court fees or expenses would be charged.
Withdrawal of action; discontinuance of proceedings and allocation of costs: when the claimant withdraws the petition, the proceedings are terminated and the case is removed from the docket. In such circumstances, the court may order that no judicial fees or costs be levied, absent a basis for a different allocation.
