RI 1 appealed the State Council’s award decision in a public procurement matter. In its reply of 28 October 2005, it withdrew the appeal. The Administrative Court therefore struck the case from the docket. Because the respondent had been represented by counsel admitted to the bar, the court awarded CHF 1,500 in ripetibili to the respondent. No court fees or other costs were charged.

la decisione 30 agosto 2005, n. 4120, del Consiglio di Stato, con la quale sono stati aggiudicati i lavori di pavimentazione per il risanamento del cavalcavia sopra l'autostrada al km 33.65 nel comune di Sigirino, Lotto 80-M146a;

preso atto che, in sede di replica 28 ottobre 2005, la ricorrente ha comunicato di ritirare il ricorso;

ritenuto che la resistente si è avvalsa del patrocinio di un legale iscritto all’albo, per cui si giustifica la corresponsione di un’indennità per ripetibili;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

2.Non si prelevano né tasse, né spese.

La ricorrente rifonderà alla resistente l’importo di fr. 1500.- a titolo di ripetibili.
