The appellants challenged a State Council decision concerning the demolition of an unlawfully built canopy. Before the administrative court ruled on the merits, their counsel informed the court that the appeal was withdrawn. The court therefore held that the proceedings were exhausted and ordered the appeal struck from the docket. It also decided that no court fees or costs would be charged.
Withdrawal of an administrative appeal; proceedings become moot and are struck from the docket. Where the appellant withdraws the remedy before judgment, the court need not decide the merits and may terminate the proceedings accordingly; in such a case it may also order that no fees or costs be collected, depending on the circumstances of the withdrawal (consid. 1-2).
