The Ticino Administrative Court dealt with an appeal against the award of furniture supply and installation contracts for the respondent's premises. Before the court decided the merits, the appellant withdrew the appeal through its counsel. The court therefore struck the matter from the docket, held that the proceeding was exhausted, and ordered limited costs. The appellant was charged CHF 300 in court fees and had to reimburse CHF 1,200 to the respondent as party compensation because the respondent had been assisted by licensed counsel.
Withdrawal of an administrative appeal entails striking the case from the docket; the proceeding is thereby terminated without a merits determination. le decisioni 30 novembre 2004 dell'CO 1, con la quale ha assegnato la delibera per la fornitura e posa di mobilio (lotti 1 e 2) per la sede dell'CO 1, __________, alla ditta CO 2 di __________;
preso atto che il 31 gennaio 2005 il patrocinatore della ricorrente ha comunicato di ritirare il ricorso;
rilevato che l'CO 1 si è avvalso dell'assistenza di un legale iscritto all'albo, per cui si giustifica la corresponsione di un'indennità per ripetibili;
ritenuto la desistenza della ricorrente, la causa può quindi essere stralciata dai ruoli con aggravio limitato di spese e tassa di giustizia;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
La tassa di giustizia di fr. 300.- è a carico della RI 1, che rifonderà fr. 1200.-- all'CO 1 a titolo di ripetibili.
