RI 1 appealed against the decision awarding food supplies for the 2005 nursing home supply contract to CO 1. Before the court ruled, RI 1 withdrew the appeal on 14 January 2005. The Ticino Administrative Court therefore struck the case from the docket. It imposed no court fees or expenses, but ordered RI 1 to pay CO 1 CHF 400 in party compensation because CO 1 had been represented by counsel.
Withdrawal of appeal; striking-off of the case: where the appellant withdraws the remedy, the proceedings become moot and are removed from the docket. If the opposing party was represented by counsel, party compensation may still be awarded despite the absence of court fees, according to the ordinary cost rules applicable to the terminated appellate proceedings.

RI 1
contro
la risoluzione 23 novembre 2004, n. 807, del CO 2, con la quale ha deliberato la fornitura di generi alimentari per la Casa per Anziani per il 2005 alla ditta CO 1;
preso atto che il 14 gennaio 2005 la ricorrente ha comunicato di ritirare il ricorso;
ritenuto che la resistente si è avvalsa del patrocinio di un legale iscritto all'albo, per cui si giustifica la corresponsione di un'indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
La ricorrente rifonderà alla resistente l'importo di fr. 400.- a titolo di ripetibili.
