RI 1 appealed a State Council decision that had confirmed a circulation-office warning. Before the administrative court decided the merits, the appellant informed the court on 15 November 2004 that he was withdrawing the appeal. The Tribunal cantonale amministrativo therefore struck the case from the roll and declared the proceedings exhausted. It also ordered that no court fees or expenses be levied.
Withdrawal of an administrative appeal before judgment; absence of a live controversy renders the proceedings moot and leads to striking the case off the roll. Where the appeal is withdrawn, the court may terminate the proceedings without charging taxes or expenses, depending on the applicable cost regime and the circumstances of the case (consid. 1-2).

la decisione 5 ottobre 2004 (n. 4451) del Consiglio di Stato, che ha respinto l’impugnativa presentata dall’insorgente avverso la decisione 23 aprile 2004 con cui la Sezione della circolazione gli ha inflitto un ammonimento;
preso atto che il 15 novembre 2004 il ricorrente ha comunicato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
