The appellant challenged a municipal award of synthetic surfacing works before the Ticino cantonal administrative court. After filing the appeal on 16 September 2004, the appellant informed the court on 22 September 2004 that it was withdrawing the appeal. The court therefore held that the proceedings were exhausted, struck the appeal from the roll, and ordered that no fees or costs be collected.
Withdrawal of an appeal before the cantonal administrative court renders the proceedings moot and justifies striking the case from the roll; in such a situation, the court may order that no judicial fees or costs be charged.
